the cell phone is gone. dead. beyond recovery.

my cell phone died yesterday around 8.30 am. Sam called to make sure I was awake, and everytime I tried to answer her call - the phone died; so I tried to call her back - and the phone died. I'd put the phone on, and a few minutes later - the phone would die. I'm devastated. BUT this is a good thing. One less distraction! YAY! however, this is a problem because I am effectively cut off from the world.

Its a sad day.

much to write home about

Finals are fast approaching. It all seems really surreal because first of all I can't believe the first semesters almost over - the ups and downs have settled to mostly downs (kidding!), the dreaded memo is in, stumbled through being called on, two amazing breaks (unHEARD of in the life of a 1L!) - and finally the last step. Finals. 3 1/2 months all depend on 10 days. Hundreds (maybe thousands?!) of pages of reading, boiled down to a 1 page checklist.

As expected, this scares me to no end. My amazing support system of upperclassmen assure me that I'll be ok - and this gives me what I call a false sense of security. I trust them - they've all gone through it - but it still freaks me out. I've never been a good test taker, especially when everything - EVERYTHING - banks on three-hours in a closed room.

Of course, when the going gets tough - Z gets melodramatic. While I hope to be so completely focused on getting ready for "the big day(s)" - I'm sure that I'm going to have melodramatic moments to share.

And hopefully hilarious ones like this - a quote from a Contracts case (based on a real case!) that is going to be my mantra for the next month. :-)

"Don't lose your head,
to save a minute.
You need your head,
your brains are in it!"
Burma Shave

I sign off with an emphatic "BRING IT ON" [Dubya style] - I just hope that it doesn't lead me into my own little quagmire.

Apologies

I messed up. I was trying to fix this stupid sidebar thats stuck all the way at the bottom of the page. If anyone has an ideas as to why this is happening - please lemme know coz I haven't got a CLUE! All I know is that bloggers messed up my page, and I'm not happy. GRR.

Bear with it. I'll continue to post, but unfortunately all my links are gone ... :-(

On a temporary up - things to be thankful for.

I'm suffering from a "crisis of being" - a great quote from Swank [as BK refers to our Legal Writing TAs - I don't quite understand which one he's talking about, but I'll keep it.] I guess that means the ups and downs are normal. Figured that I'd take the opportunity of Thanksgiving coming up to make my list of things that I'm thankful for :-)

  • Fall - the weather has been great, not too cold, a little rainy - but for almost Thanksgiving its AWESOME! I remember the bitter November cold and I'm glad that its not really here yet. The Oakland area is actually very picturesque - and the walk home is lined with trees that are just bursting with those beautiful fall colors. Subha'anAllah!
  • UBER Cool upper-class law students - I've been lucky enough to have found some REALLY great 2Ls and 3Ls that have miraculously appeared at my side whenever I've felt like collapsing. I sometimes feel like I'm constantly complaining - but they're so patient with me that I'm only encouraged to do it more! I promise, I'll stop soon - once I get a handle on this. Whenever that is. Btw, this also includes cool 2Ls from other schools like Lang and amnarani :0)
  • FANTASTIC TAs - they get their own bullet because they are literally saving my life, I mean my memo, wait - I was right the first time - they're saving my life.
  • Thankful that I'm not suffering under the 80 volume Factual Information Submission at 1700. Wu, my sympathies are with you.
  • Comic relief - for the most part my section is fantabulous about keeping things light, and in spite of the absolutely magnanamous stress ball that we're under - we always find a way to laugh at least once EVERY class. It's great.
  • Animal crackers - although I'm getting sick of them
  • The MONSTER bar of Toblerone sitting next to my computer.
  • THANKSGIVING IS ONLY A WEEK AWAY! WOOOOOOOOO!!!
  • BOB
  • My oh-so-comfortable-but-oh-so-ragged-15-year-old-Levi's-T-shirt that is SO COMFORTABLE

There are many more things that I'm thankful for, but I need to get back to work.

Follow up on "You're kidding me right ..."

Not surprisingly, I'm not the only one that thinks this whole lets-get-rid-of-habeaus-corpus-for-detainees stuff stinks. Much to read about ... enjoy!

Detainees deserve Court Trials:
talks about a detainee that was found innocent by a military tribunal, but was kept a secret ...

"The military people reached this conclusion, and they wrote it down on a memo, and then they classified the memo and Adel went from the hearing room back to his prison cell. He is a prisoner today, eight months later. And these facts would still be a secret but for one thing: habeas corpus." -- P. Sabin Willett, Detainees Deserve Court Trials, Washington Post, November 14, 2005, http://www.washingtonpost.com/wp-dyn/content/article/2005/11/13/AR2005111301061.html?referrer=emailarticle.

Doing Unto Others as They Did Unto Us:
About Gitmo torture tactics that mimic the Red Army method - tactics that they used to train soldiers on how to resist abuse.

"The Pentagon effectively signed off on a strategy that mimics Red Army methods. But those tactics were not only inhumane, they were ineffective. For Communist interrogators, truth was beside the point: their aim was to force compliance to the point of false confession" -- M. GREGG BLOCHE and JONATHAN H. MARKS, Doing Unto Others as They Did Unto Us, N.Y. Times, November 14, 2005, http://www.nytimes.com/2005/11/14/opinion/14blochemarks.html?ex=1289624400&en=071376aa07025d49&ei=5088&partner=rssnyt&emc=rss.

[yes, those are in blue book format.]

You're kidding me right ...

I'm so mad that I can't even speak ... this is insane. What is going on - have people lost all their moral sensibilites? What ever happened to justice damnit.

http://nytimes.com/2005/11/11/politics/11detain.html?hp&ex=1131685200&en=eacb589a0ee7f4b3&ei=5094&partner=homepage

For those that choose not to read the whole article - lemme give you some quotes:

What does this mean?

"Under Mr. Graham's measure, prisoners at Guantánamo Bay would be able to challenge only the narrow question of whether the government followed the procedures established by the secretary of defense at the time the military determined the prisoners' status as an enemy combatant, which is subject to an annual review. The United States Court of Appeals for the District of Columbia would retain the right to rule on that, but not on other aspects of a prisoner's case."

"If it stands, it means detainees at Guantánamo Bay would have no access to any federal court for anything other than very simple procedural complaints dealing with annual status review," said Christopher E. Anders, a legislative counsel for the American Civil Liberties Union. "Otherwise, the federal courts' door is shut."

This one really gets me -

"It is not fair to our troops fighting in the war on terror to be sued in every court in the land by our enemies based on every possible complaint," Mr. Graham said in a statement after the vote. "We have done nothing today but return to the basics of the law of armed conflict where we are dealing with enemy combatants, not common criminals."

--- no, not on every possible complaint Mr. Graham - I think they just want to have their day in court to PROVE that there is no REASON to keep them in Gitmo.

Just think about this - the definition of enemy combatant is a soldier or guerrilla member who is waging war. For a second, just clear your mind of any prejudices you may have against these people - and just think about the circumstances in which they were rounded up.

Also think about this - detainees in Gitmo have been detained since whwat 2001-2002 ... no access to a court, held indefinately - no proof of whether they were actually "enemy combatants" [seriously damnit - just call 'em what they are - POW's ... yes, that is what they are!], even if there was proof - who the hell cares right? lets not put a face to these people ... daily interrogation w/electric shock, isolation, sleep deprivation and God knows what else. Stripped of their dignity, disallowed from practicing their faith - in fact, metaphorically flushing it down the toilet [yes I went there], now stripped of their chance for justice. Mr. Graham - your sense of fairness blows my mind.

If you have time - read this too ... http://web.amnesty.org/library/index/engamr511412003

You know that if American soldiers were being treated ANYWHERE CLOSE to as badly as we're treating these POW's - there would be mass hysteria. Just because they're not American doesn't mean that they deserve any less.

Believe it or not they're human too. and you know what ... there's the slightest, most miniscule chance that they could be innocent. It's not that hard to imagine. Go ahead ... let your mind go wild.

Reflections of a disoriented 1L (quoting Lifehouse)

Been listening to LIFEHOUSE a lot the past couple of days, and I really feel that two of their songs completely sum up whats going thru my head.

"Somewhere in between"

“I can’t be losing sleep over this…no I can’t.
No I cannot stop pacing.
Give me a few hours, I’ll have this all sorted out, if my mind would just stop racing.

Coz I can’t stand still.
I can’t be this unsturdy.
this cannot be happening.

This is over my head but underneath my feet,
coz by tomorrow morning, I’ll have this thing beat.
And everything will be back to the way that it was.
I wish that it was just that easy.

Coz I’m waiting for tonight, then waiting for tomorrow.
I’m somewhere in between what is real and just a dream.”

"Trying"

Honesty is a hard attribute to find
When we all want to seem like we've got it all figured out
Well let me be the first to say that I don't have a clue
I don't have all the answers
Ain't gonna pretend like I do, I'm just trying - to find my way
Trying - to find my way the best that I know how

If I quote all the lines off the top of my head
Will you believe that I fully un-derstand all these things I've read

I'm just trying - to find my way, the best that I know how.

Only in the 'burgh

would one hear Hall & Oates - "You make my dreams" [probably a top 40 song at least 20 years ago] twice within 6 hours, on TWO DIFFERENT stations!

You know you love the 80's.
